IFLR Project finance deal of the year - Pekin & Pekin makes shortlist |

Pekin & Pekin has been nominated by IFLR for Project Finance Deal of the Year following its work on the Yeni Elektrik transaction, lauded as the first true limited recourse financing of a CCGT plant.
The project financing was granted to Yeni Elektrik Üretim A.Ş., a project company jointly owned by Unit Investment N.V. (60%) and Ansaldo Energia S.p.A. (40%). The lead arrangers were Turkish banks Yapi ve Kredi Bankasi A.Ş., Türkiye İş Bankasi A.Ş., Vakiflar Bankasi T.A.O. and Türkiye Garanti Bankasi A.Ş. and the facility consisted of a term loan USD700mn and a letter of guarantee USD80mn.
The Energy & Climate Change team advised a foreign party on both the acquisition and the project financing aspects of the transaction.

PPPs in Turkey is the hot deal ticket with international investors and legal counsel discussing Turkey's efforts to introduce a uniform legal framework via the draft PPP law. Particular sectors under focus are transportation (highways, ports, airports and railways), energy and healthcare. The scope of PPPs is no longer restricted to infrastructure and has become broader incorporating service delivery as efficiency and value-driven solutions are required.

A number of international and local foreign exchange trading houses were expecting the Turkish Capital Markets Board (CMB) to legitimize their activities in the Turkish market by issuing the required framework regulation. On 27 August 2011, the CMB finally issued Regulation V/125.1. This article analyses the trading framework as introduced by Regulation V/125 together with its tax ramifications.
