Q1-2010 Supportive approach for the termination of employment contracts with just cause |

A Draft Law that envisages amendments to the Labour Code is on the agenda of the Justice Commission. One of the most significant amendments is the expansion of the application of the obligation on employers, willing to terminate the indefinite-termed employment contract of any employees, imposed under Article 18 of the Labour Code entitled “Termination of Employment Contracts with Just Cause”. Moreover, it is stipulated that contracts terminated without a valid reason upon which the employee is not re-employed by the employer shall be deemed as continuing without interruption. Therefore, such employees will be entitled to receive a salary for the periods they were not employed by their employer.
