In the Court of Appeal’s decision (File No: 2009/10982 E.) the Court ruled that the decisions of Consumer Dispute Arbitration Committees shall be used only as evidence in Consumer Courts, unless the application to the Committee is compulsory as per the law. Additionally, it is stated that the existence of a legal interest is a mandatory requirement for filing a lawsuit in this respect, and the existence of such interest shall be analyzed by the Court in its own capacity at every stage of the lawsuit. Moreover, it was decided that there is no legal interest in requesting the annulment of a Consumer Dispute Arbitration Committee’s decision, deemed as evidence, prior to the filing of the principle case.
